End User License Agreement

This END USER LICENSE AGREEMENT (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and KahaniKids.ai (“we,” “us,” or “our”) regarding the use of our mobile application (“App”). By downloading, installing, or using the App, you agree to comply with and be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the App.

1. License Grant

Subject to your compliance with this Agreement, KahaniKids.ai grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App on a compatible mobile device that you own or control, solely for your personal, non-commercial use. This license is provided in accordance with the terms and conditions set forth by the Google Play Store and Apple App Store.

2. Ownership and Intellectual Property Rights

App Ownership. The App, including all intellectual property rights such as copyrights, patents, trademarks, and trade secrets, is the exclusive property of KahaniKids.ai or its licensors. This Agreement does not grant you any ownership rights in the App or its content.

Content Ownership. All content, including text, graphics, logos, images, software, and other materials available within the App, is owned or licensed by KahaniKids.ai. You are prohibited from using any content without prior written permission, except as permitted by this Agreement.

3. Permitted Uses and Restrictions

Permitted Uses. You may use the App solely for your personal, non-commercial purposes. The App may only be installed and used on devices that you own or control, and you may not share access to the App with others.

Prohibited Uses. You may not:

  • Copy, reproduce, distribute, or transmit the App or its content;
  • Modify, translate, adapt, or create derivative works based on the App;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
  • Rent, lease, lend, sell, redistribute, or sublicense the App;
  • Use the App for any illegal, unethical, or unauthorized purpose;
  • Bypass or circumvent any security measures used to prevent unauthorized access to the App;
  • Interfere with or disrupt the App, servers, or networks connected to the App.

4. Privacy and Data Collection

Privacy Policy. Your use of the App is subject to KahaniKids.ai’s Privacy Policy, which is incorporated into this Agreement by reference.

User Data. By using the App, you agree to the collection and use of your data as outlined in the Privacy Policy. You are responsible for ensuring the accuracy of the information you provide to us.

5. App Store Terms and Conditions

Third-Party App Store Providers. This Agreement is between you and KahaniKids.ai, not with Google, Inc. or Apple Inc. (collectively, “App Store Providers”). Your use of the App must comply with the terms and conditions set forth by the App Store Providers.

App Store Compliance. In case of any conflict between this Agreement and the terms set forth by the App Store Providers, the terms of the App Store Providers will govern. You acknowledge that the App Store Providers are not responsible for the App, its content, or any claims related to the App, including claims under consumer protection or intellectual property laws.

6. Updates and Modifications

App Updates. KahaniKids.ai may release updates, patches, or new versions of the App from time to time. These may be automatically installed on your device.

Modifications to Agreement. KahaniKids.ai reserves the right to modify this Agreement at any time. Changes are effective immediately upon posting the updated Agreement within the App or on our website. Your continued use after any changes constitutes acceptance of the new terms.

7. Termination

Termination by You. You may terminate this Agreement at any time by uninstalling the App and ceasing all use.

Termination by Us. We may, in our sole discretion, suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated this Agreement.

Effect of Termination. Upon termination, all licenses granted to you under this Agreement immediately cease, and you must stop all use of the App and delete all copies from your device.

8. Disclaimer of Warranties

“As Is” and “As Available” Basis. The App is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. KahaniKids.ai disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Warranty of Functionality. KahaniKids.ai does not warrant that the App will meet your requirements, be error-free, uninterrupted, secure, or free from viruses or other harmful components. You assume all risks associated with your use of the App.

Parent/Guardian Responsibility. All interaction performed on the App and any user-generated content published on the App is the sole responsibility of the user; where the user is a minor, the parent or guardian is responsible for such actions and content, to the maximum extent allowed by law.

9. Limitation of Liability

Exclusion of Damages. To the fullest extent permitted by law, KahaniKids.ai shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages.

Maximum Liability. In any event, KahaniKids.ai’s total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you, if any, for the App.

10. Governing Law and Dispute Resolution

Governing Law. This Agreement is governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.

Dispute Resolution. Any disputes arising under or in connection with this Agreement shall be resolved through binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its Arbitration Rules, seated in Singapore, on an individual basis and not as part of a class action. If arbitration is unavailable or unenforceable, the parties submit to the exclusive jurisdiction of the courts of Singapore.

11. Miscellaneous

Indemnification. You agree to indemnify, defend, and hold harmless KahaniKids.ai, its affiliates, and their officers, directors, employees, and agents from claims, liabilities, damages, losses, costs, expenses, or fees arising out of or related to your use of the App, your violation of this Agreement, or your violation of a third party’s rights.

Third-Party Beneficiaries. The App Store Providers and their subsidiaries are third-party beneficiaries of this Agreement, with the right to enforce it against you.

Export Compliance. You agree to comply with all applicable laws regarding technical data exported from your country of residence, and not to use the App for purposes prohibited by applicable law, including development of weapons.

Severability. If any provision of this Agreement is found invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions remain in full force.

Entire Agreement. This Agreement, along with the Privacy Policy and any other legal notices we publish, constitutes the entire agreement between you and KahaniKids.ai concerning the App.

No Waiver. Our failure to enforce any right or provision of this Agreement will not constitute a waiver of it.

Assignment. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may freely assign our rights and obligations under this Agreement.
